PAPERLESS ORDER DENYING54 Defendant's Expedited Motion for Reconsideration of Order Granting Emergency Motion and Motion for Protective Order filed by Eric Schnairsohn. Pursuant to Fed. R. Civ. P. 26(c)(1)(E), a "court may for good cause, issue an order to protect a party or person from annoyance, embarrassment, oppression, or undue burden or expense, including... designating the persons who may be present while the discovery is conducted." "For good cause to exist, the party seeking protection bears the burden of showing specific prejudice or harm will result if no protective order is granted." Huddleston v. Bowling Green Inn of Pensacola, 333 F.R.D. 581, 584 (N.D. Fla. 2019) (quoting Phillips ex rel. Estates of Byrd v. Gen. Motors Corp., 307 F.3d 1206, 1210 (9th Cir. 2002)). Defendant's proffered reasons for excluding Lori Wojciechowski from future depositions are insufficient to meet this good cause standard. Defendant attempts to exclude Lori Wojciechowski merely because she is a material witness, the former CEO of the Plaintiff, filed affidavits, and is listed as a witness for the upcoming hearing. [See ECF No. 54 par. 5]. None of these reasons show the specific prejudice or harm that would result to the Defendant if the protective order is not issued by this Court. Because the Defendant fails to establish good cause, the Motion for a Protective Order must be denied. See Seattle Times Co. v. Rhinehart, 467 U.S. 20, 36 (1984) ("Rule 26(c) confers broad discretion on the trial court to decide when a protective order is appropriate and what degree of protection is required."). Plaintiff Intra Management Solutions, Inc., filed an Emergency Motion to Allow Witnesses, Matt Wojciechowski and Lori Wojciechowski, to attend the current deposition of Defendant, Eric Schnairsohn. [ECF No. 52]. "The examination and cross-examination of a deponent proceed as they would at trial under the Federal Rules of Evidence, except Rules 103 and 615." Fed. R. Civ. P. 30(c). Fed. R. Evid. 615 allows sequestration of a witness only at the party's request, and that Rule is specifically excepted from Rule 30(c). Thus, witnesses are not automatically excluded from a deposition upon a party's request. See Woliner v. Sofronsky, 2018 WL 4404066, Case No. 18-cv-80305 (S.D. Fla. Sept. 13, 2018). Rather, good cause must be shown for such an exclusion, or a motion for protective order must be made. No request has been made by Defendant to exclude witnesses from the depositions, and no basis of good cause for Defendant to exclude Matt Wojciechowski and Lori Wojciechowski has been shown.
