ORDER OF DISMISSAL: By order dated October 13, 2016, the Court directed Plaintiff to submit a prisoner authorization form. On October 31, 2016, the Court received a letter from Plaintiff, stating that he recently learned that this Court is not the proper court to file his complaint and requests that the Court return his "paperwork," so that he may submit his complaint in the "proper forum." (ECF No. 8.) The Court grants Plaintiff's request to withdraw this action under Rule 41(a) of the Federal Rules of Civil Procedure. The Clerk of Court is directed to mail copies of this order and the following documents to Plaintiff and note service on the docket: Plaintiff's complaint (ECF No. 2); the Motion for Preliminary Injunction (ECF No. 3); Motion to Appoint Counsel (ECF No. 4); Memorandum of Law (ECF No. 5), and Declaration (ECF No. 6). The complaint is voluntarily dismissed pursuant to Fed. R. Civ. P. 41(a). The Court certifies, pursuant to 28 U.S.C. § 1915(a)(3), that any appeal from this order would not be taken in good faith and therefore in forma pauperis status is denied for the purpose of an appeal.
