ORDER that44 Motion to Dismiss Claims of Second Consolidated Supplemental and Amended Complaint is GRANTED IN PART and DENIED IN PART and46 Motion to Dismiss is GRANTED. All of Plaintiffs claims against LPSB and the Individual Defendants, whether in their official or individual capacities, with the exception of (1) Plaintiffs negligent infliction of emotional distress claim against the Individual Defendants and (2) Plaintiffs vicarious liability claim against LPSB, are DISMISSED WITH PREJUDICE. The Court DECLINES to exercise supplemental jurisdiction over Plaintiffs negligent infliction of emotional distress claim and claim for vicarious liability arising therefrom. Those claims are DIMISSED WITHOUT PREJUDICE. This dismissal is STAYED for thirty (30) days from the date of this ruling in order to provide Plaintiffs counsel time to file those claims in state court.
