ORDER. Plaintiffs' Motion for Preliminary Injunction 2 is GRANTED. Defendant Wayne W. Williams is preliminarily enjoined and restrained from enforcing that portion of Colo. Rev. Stat. § 1-4-905(1) that requires that petition circulators be residents of the State of Colorado. Defendant Wayne W. Williams shall certify Douglas Lamborn to the 2018 Republican primary ballot for the Fifth Congressional District unless, for reasons other than the residency requirement discussed in this order, he does not qualify. Pursuant to Fed. R. Civ. P. 65(c), the Court will not require the posting of a bond in this matter. ORDER. The parties' Joint Motion to Consolidate Preliminary Injunction Hearing with Trial on the Merits and for Entry of Judgment 59 is GRANTED. The Colorado Secretary of State is permanently enjoined from enforcing those portions of Colo. Rev. Stat. § 1-4-905(1) that require petition circulators to be registered voters and residents of the State of Colorado.
