ORDER granting in part and denying in part 14 Motion to Dismiss for Failure to State a Claim. Plaintiff Petefish's AFCA claims that pre-date 9/8/2017 are dismissed with prejudice as barred by the applicable statute of limitations. Plaintiff Brown's request for monetary relief under ICEFDPA is dismissed with prejudice because such relief is not available. Plaintiff Jacobson's NDTPA claim is dismissed without prejudice. Plaintiff Jacobson is granted leave to amend by 7/10/2019 to allege, with factual allegations that he is among the class of persons that may assert an NDTPA claim. The New York GBL claims asserted on behalf of a nationwide class are dismissed with prejudice. This ruling does not affect any claims asserted on behalf of a New York single-state putative subclass.
