8 8 MINUTE ORDER This matter is before the Court pursuant to7 Notice to the Clerk of the Court. The Notice states: "Per a Transfer Order of the United States Judicial Panel on Multidistrict Litigation, case MDL number 2804, a copy of which is attached hereto as Exhibit A, this case is to be includ[ed] [in] the multidistrict litigation, conducted in the United States District Court for the Northern District of Ohio, Eastern Division." Plaintiff thus requests that the Clerk of Court "transfer this action pursuant to the above-referenced transfer order." The Transfer Order attached to the Notice, however, was issued by the United States Judicial Panel on Multidistrict Litigation (the "MDL Panel") prior to the filing of the instant lawsuit and Schedule A attached to the Transfer Order identifying the cases to which the Order applies does not include the current lawsuit. The Transfer Order provided thus does not authorize the requested transfer. Pursuant to Rule of Procedure 7.1(a) of the MDL Panel, "[a] ny party or counsel in actions previously transferred under Section 1407 shall promptly notify the Clerk of the Panel of any potential tag-along actions in which that party is also named or in which that counsel appears." The Clerk of the MDL Panel then "may enter a conditional order transferring that action to the previously designated transferee district court for the reasons expressed in the Panels previous opinions and orders." MDL Rule 7.1(b). The parties do not appear to have yet obtained such an order for this tag-along action and transfer by the Clerk of this Court thus is premature. A Status Conference is set for 8/08/2018 at 11:00 AM in Courtroom C203 before Magistrate Judge Scott T. Varholak. SO ORDERED, by Magistrate Judge Scott T. Varholak on 6/01/2018.
