ENDORSED ORDER: On August 13, 2020, the Court held a hearing to address the issue of Plaintiff's standing to pursue this lawsuit because it did not appear that she had been appointed the personal representative of her daughter's estate. (Doc. 129 ). Plaintiff was previously warned in January about her ability to proceed in this action, and she was given the opportunity to cure standing issues. (Doc. 115 ). After she failed to do so, the Court set a hearing to more directly address this issue. At the hearing, Plaintiff agreed to take the steps necessary to become appointed as the personal representative of her daughter's estate. As such, Plaintiff was directed to submit documentation within fourteen days to establish that she had been appointed the personal representative, and she was warned that a failure to do so would result in the dismissal of this action without prejudice without further notice. More than fourteen days has passed, and Plaintiff has failed to submit any documentation. Consequently, this action is dismissed without prejudice. The Clerk is directed to terminate any pending motions and deadlines, and thereafter close this case. Signed by Judge Thomas P. Barber on 9/1/2020. (ANL) |
