MINUTE ORDER IN CHAMBERS by Judge Otis D. Wright, II: On October 22, 2024, the Court received the Mandate of the Ninth Circuit, affirming in part, reversing in part, and remanding this matter back to this Court. (ECF No. 252.) The Mandate is spread; this Court once again has jurisdiction over this action. This Court's Judgment issued on March 30, 2023245 , is hereby VACATED. The Courts Order granting summary judgment to Defendant, (ECF No. 243), remains in effect as to all the Court's holdings, with the sole exception of Plaintiffs claim under Section 222 of the Federal Communications Act, (see Op. 28, ECF No. 251). In light of the Ninth Circuit's Mandate, the Court ORDERS the parties to meet and confer and submit a joint report no later than November 25, 2024, addressing the outstanding matters in this case and how the parties envision resolving them, as well as proposing trial and pre-trial dates, and briefing schedules for anticipated motions, if any.
