ORDER: In my order of July 25, 2023 (ECF No. 148), I stated, among other things, that Mr. St. Pauls balance due was $2500, with the requirement for weekly payments remaining in effect; that if Mr. St. Paul did not make a payment the next week, theoretically the sanction would be $1600; but because the situation was getting out of hand -- entirely as a result of Mr. St. Paul's conduct -- I w[ould] restart the sanctions at $100 per week. By restart[ing]... at $100 per week, I meant that as had been the case since June the first missed week would result in a sanction of $100, the second missed week would result in a sanction of $200, etc. In other words, the sanction would double each missed week. By my count that would make Mr. St. Pauls balance $14,700. But because arguably my order could be read as stating the sanction would be a flat $100 per week, I will calculate it that way, which results in a balance of $2700 ($2500, plus $700 for seven missed weeks, less $500 for a payment made on 9/20/23). By this Order, I make clear that if no payment is made this week, the sanction will be $100, and that sanction will double for each subsequent week in which no payment is made. I remain mystified as to why Mr. St. Paul neither makes the required payments, nor seeks an extension of time or any other relief. At this rate he will literally never pay off his debt. Should the situation continue, I will have to consider other options. (HEREBY ORDERED by Judge Cathy Seibel) (Text Only Order) (Seibel, Cathy) |
