MEMORANDUM AND ORDER: For the reasons set forth above, defendants motion to dismiss is granted. Plaintiff is granted leave to amend his pleading to allege a federal claim. ORDER: Plaintiff's2 application to proceed in forma pauperis under 28 U.S.C. § 1915 is hereby granted. The United States Marshal Service is directed to serve the summons, complaint, and this Order upon defendants Joseph Rehal and Senior Parole Officer Todd without prepayment of fees. A courtesy copy of the same papers shall be mailed to the Suffolk County Attorney. Pursuant to Valentin v. Dinkins , 121 F.3d 72 (2d. Cir. 1997) (per curiam), the Court requests that the Suffolk County Attorney ascertain the full names and service addresses of the John Doe defendants allegedly involved in this 10/4/2018 incident. The County Attorney is further requested to produce the information specified regarding the identity of the John Doe defendants within 45 days from the entry of this Order . Once this information is provided, plaintiff's complaint shall be deemed amended to reflect the full names of the defendants and the Court shall direct additional service accordingly.
