ORDER denying34 Respondent-Appellant's request for an additional thirty-day extension of the court's stay pending an expedited appeal decision. Respondent's request does not satisfy the "four traditional stay factors" that this court must apply when considering whether to stay a return order pursuant to the Hague Convention. See Chafin v. Chafin , 568 U.S. 165, 179 (2013). Respondent is unlikely to succeed on the merits for reasons previously stated in the Memorandum & Order, dated October 15, 2019. (ECF No. 32.) Respondent has not demonstrated that she will suffer irreparable harm absent a stay, and to the extent such harm may arise, it is a consequence of her decision not to return to Ecuador. Petitioner will, however, suffer deprivation of his parental rights as a result of the stay's continuance, and thus will be substantially injured. Finally, the Hague Convention militates the "prompt return of children wrongfully removed to or retained in any Contracting State." Chafin , 568 U.S. at 168. Accordingly, the public interest warrants denial of Respondent's stay request. Further, Respondent's contention that her appeal will be rendered moot by enforcement of the stay order is contrary to this Circuit's precedent. See Hofmann v. Sender , 716 F.3d 282, 290 (2d Cir. 2013) ("[T]he fact that the parties' children have already been returned to [country of habitual residence] pursuant to the district court's order does not render this appeal moot. It remains a live case and controversy.") (quoting Chafin , 568 U.S. at 180). Matsumoto, why an Order should not be issued pursuant to the Convention of the Civil Aspects of International Child Abduction, done at the Hague on 10/25/1980 and the International Child Abduction Remedies Act, 22 USC sec. 9001 et seq., as herein described.
