270 270 order Order ~Util - Set Motion and R&R Deadlines/Hearings ~Util - Terminate Motions Tue 02/11 3:10 PM
TEXT ORDER granting 269 motion for extension of time. Lead Plaintiff's responses to 257 motion to exclude opinions of Alberto Ferrer and derivative opinions of Lynn Turner and 258 motion to exclude loss causation and damages opinions of Matthew D. Cain are due by March 14, 2025, and Defendants' replies are due by April 4, 2025. Additionally, as referenced in the motion for extension of time, the parties have submitted a letter to the undersigned regarding a discovery dispute concerning a second corrected expert report from Mark Anderson and have requested a telephone conference regarding this dispute. This Court's standard filing preferences, located on the Court's website, provide that "[c]ommunications to the court should normally be in the form of a FILED written communication (i.e., motion, memorandum, status report, or other traditionally filed document)" and that "[o]ther forms of communication (e.g., facsimile, mail, email, hand delivery, or phone) are prohibited unless expressly authorized by judge-specific preference, local rule, or other specific authorization." The undersigned's filing preferences specifically provide that "[c]orrespondence addressed to Judge Austin is strongly discouraged." Accordingly, the Court declines to address the unauthorized letter. Nonetheless, the Court notes that the dispute raised appears to be one that should be able to be resolved by the fine counsel in this case without Court intervention, and the Court strongly encourages the parties to work together on a resolution. Signed by the Honorable Jacquelyn D. Austin on February 11, 2025. (ahil)
