For the reasons stated on the record, the Court issues the following ruling(s): (1) Plaintiff's Motion to Dismiss the Defendants' Notice of Appeal in case 20 CV 121 is GRANTED because the Bankruptcy Court's Partial Summary Judgment ruling on Counts II and IV is not a final judgment, order, or decree under 28 U.S.C. § 158(a)(1); (2) Defendants' Motion for Leave to Appeal in case 20 CV 132 is DENIED because the Bankruptcy Court's partial grant of summary judgment does not involve a controlling question of law as to which there is a substantial ground for difference of opinion that may materially advance the ultimate termination of the litigation through an immediate appeal; and (3) Defendants' Motion to Withdraw the bankruptcy reference in case 19 CV 9354 is GRANTED because the Orion factors, as modified by Stern, favor withdrawing the reference as to Counts I through V now that they are trial ready. Case 19 CV 9354 is hereby STAYED pending the outcome of appeal of Counts VI and VII before the Bankruptcy Court. The Clerk of Court is directed to terminate Motion # 1 in case 19 CV 9354, Motions # 17 and 21 in case 20 CV 121, and Motion # 4 in case 20 CV 132. The Clerk of Court is directed to close cases 20 CV 121 and 20 CV 132. See transcript.
