TEXT ORDER: On August 13, 2021, the Court granted in part and denied in part Defendant's motion to dismiss (d/e7 ) and gave Plaintiff leave to refile within 21 days from that date an Amended Complaint addressing the deficiencies identified in the Court's order (d/e12 ). After nearly four months in which Plaintiff had not filed an Amended Complaint, the Court directed Plaintiff on December 7, 2021 to show cause by December 20, 2021 why this case should not be dismissed under Federal Rule of Civil Procedure 41(b) for failure to prosecute. Plaintiff has yet to either file an Amended Complaint or show cause as directed. Therefore, this case is dismissed without prejudice. No judgment to enter. Each party to bear his own costs. Plaintiff also has not identified what efforts, if any, have been made to serve the Defendant.
