TEXT ORDER DENYING MOTION TO VACATE ADMINISTRATIVE CLOSING ORDER FOR NON-COMPLIANCE: Pursuant to the verbal order of the Hon. David N. Hurd, USDJ, plaintiff's8 Motion to Vacate this Court's Order7 Directing Administrative Closure with Opportunity to Comply with Filing Fee Requirement is Denied. See Caidor v. Onondaga County, 517 F.3d 601, 605 (2d Cir. 2008) (explaining that special solicitude afforded to pro se litigants does not relieve an uncounseled plaintiff of the obligation to comply with a clear and obvious procedural requirement); see also Lucas v. Miles, 84 F.3d 532, 538 (2d Cir.1996) (Jacobs, J., dissenting) ("The concept of 'sixty days' can be understood and appreciated without a legal education. (One would have to be a lawyer to believe that 'sixty days' is an elusive concept.)'"). In the Court's Order, dated September 28, 2020, the Plaintiff was specifically directed to comply, stating, "that if plaintiff desires to pursue this action, WITHIN THIRTY (30) DAYS of the filing date of this Order, plaintiff must pay the Court's full $400.00 filing fee for civil actions". As the compliance deadline for this order was October 28, 2020, the8 Motion to Vacate is denied in all respects and the Clerk is directed to return any filing fee that may have been submitted, along with a copy of this order to the plaintiff's address of record: Peter Tasciotti, 130 Cedar Drive, Kerhonkson, NY 12446.
