By agreement and consent of all the parties and pursuant to the CARES Act, all parties appear by telephone conference. Defendant was informed of his rights, the nature of the charges and the maximum penalties. Michael Nash of the Federal Defender Panel is assigned as counsel for Defendant subject to submission of a financial affidavit. Defendant was informed of his right to a preliminary hearing. Defendant exercised his right to a preliminary hearing. Preliminary hearing set for 7/16/20 at 10:00 a.m. before Judge Gilbert. The preliminary hearing will proceed by telephone unless Defense counsel notifies the Court's courtroom deputy and the AUSA by 7/10/20 that Defendant elects to proceed by video or in person. The Government orally moved to detain Defendant pursuant to 18 U.S.C. § 3142(f)(2)(A). In accordance with 18 U.S.C. § 3142(f)(2)(A), and at the parties' agreement, a detention hearing is set for 7/9/20 at 4:00 p.m. via telephone conference. The Court's call-in number is 877-336-1829, Access Code 1022195. As provided by 18 U.S.C. § 3142(f)(2), Defendant is remanded to the custody of the U.S. Marshal and shall remain in custody until further order of the Court. It is ordered that Defendant shall remain confined in the Metropolitan Correction Center or an alternative facility designated by the U.S. Marshal, but held separate, to the extent practicable, from persons awaiting or serving sentences or being held in custody pending appeal. It is further ordered that Defendant shall be afforded reasonable opportunity for private consultation with his counsel while in custody. On the Government's oral motion, case ordered unsealed.
