9 9 EP: TELEPHONIC DETENTION HEARING AS TO DEFENDANT AUSTIN WHITE held. Waiver of Physical Presence and Consent to Proceed by Telephone : Defendant is in custody and present via telephone from the Federal Detention Center. Mr. Ishibashi represents Defendant intends to waive his right to be physically present and consents to appear via telephone. Court conducted a colloquy to confirm Defendant's waiver and consent. Detention Hearing : The Court taking judicial notice of the records and files, the Pretrial Services' report and having considered comments of counsel, finds the conditions recommended by Pretrial Services sufficient to reasonably assure the appearance of the defendant as required and the safety of the community. Accordingly, the Court finds that the Defendant has rebutted the presumption for detention relied upon by the Government in its Motion to Detain. Government's MOTION TO DETAIN DEFENDANT WITHOUT BAIL [ECF6 ] is DENIED. Mr. Ishibashi to prepare and submit order to the Court's orders box at Trader_Orders@hid.uscourts.gov by May 19, 2020. The Government and Defendant agree with the recommendation of Pretrial Services. Court adopts the recommendation of Pretrial Services and orders defendant released on an UNSECURED BOND in the amount of $50,000.00 with conditions ( See attached minutes ) The Court reviewed the above release conditions with defendant. Defendant advised of possible adverse action for failure to comply with any condition, to include issuance of a warrant for defendant's arrest, revocation of release status and detention pending final outcome of this matter. Defendant acknowledged understanding the foregoing release conditions, his obligation to comply and the consequences of violating any conditions of release. Ms. White acknowledged the terms of release and her responsibilities as the Defendant's third-party custodian as follows: 1. Supervise the Defendant consistent with stated conditions; 2. Use every effort to assure defendant's appearance at all court proceedings and; 3. Notify Court immediately if the Defendant violates any conditions of release or is no longer in her custody. Ms. White understands failure to comply with her responsibilities may result in consequences, including possible contempt of court. These minutes will serve as the conditions of bond. IT IS SO ORDERED. Defendant to remain in custody at the Federal Detention Center until notification by Pretrial Services Office that all conditions of release have been satisfied.
