It is hereby ORDERED that, within fifteen working days of Purdue Plaintiffs providing the Defendants with a list of the Federal Employer Identification Numbers and legal business names of all employers who are plaintiffs in this case or who are members of plaintiff organizations in this case, Defendants will reissue all prevailing wage determinations ("PWDs") issued under the Interim Final Rule ("IFR"), Strengthening Wage Protections for the Temporary and Permanent Employment of Certain Aliens in the United States, 85 Fed. Reg. 63,872 (Oct. 8, 2020), that have not yet been used in the filing of a Labor Condition Application ("LCA") or PERM application and that fall into one or more of the following categories: (1) PWDs issued to all named Purdue Plaintiffs and members of the Associational Purdue Plaintiffs; (2) PWDs that an employer requested to support the filing of a LCA under the H-1B, H-1B1, and E-3 visa classifications that has not yet been filed as of the effective date of this order; (3) PWDs issued that resulted in the default wage rate of $100.00 per hour or $208,000 per year; and (4) PWDs issued for job opportunities in healthcare related occupations, as defined by the Standard Occupational Classification system codes 29-0000 and 31-0000 series. It is FURTHER ORDERED that Defendants will allow all other employers who were issued PWDs under the IFR to apply for reissuance of the PWD based on emergency circumstances until February 8, 2021. Defendants will reissue PWDs for these requests by March 2, 2021. It is FURTHER ORDERED that Defendants will post web announcements reflecting this order and that they will send an email to the requestor point-of-contact on each affected PWD to make the requestor aware of the process for obtaining a reissuance. In view of7 plaintiffs' motion for preliminary injunction or APA stay, plaintiffs are HEREBY DIRECTED to contact forthwith the United States Attorneys Office for the District of Columbia and/or the Department of Justice as appropriate to identify government counsel. The parties shall thereafter file a joint status report by no later than October 28, 2020 at 12:00 PM NOON with recommendations for further proceedings, including, inter alia, (1) whether plaintiffs' motion for a preliminary injunction should be consolidated with the merits under Federal Rule of Civil Procedure 65; and (2) recommendations for further proceedings including, if necessary, a briefing schedule for plaintiffs' motion for a preliminary injunction.
