ORDER ACCEPTING JOINT STATUS REPORT AND NOTICE OF VOLUNTARY DISMISSAL AND CLOSING CASE ON THE DOCKET (see ECF No. 314 at 1:21-mc-1). The Joint Status Report of the parties (ECF No. 313 at 1:21-mc-1), and the Notice of Voluntary Dismissal (ECF No. 311 at 1:21-mc-1) are hereby accepted and approved. The claims at Counts I-IV of the Consolidated Amended Complaint were previously dismissed with prejudice by Order of this Court (ECF No. 286 at 1:21-mc-1), and the remaining claims of the Consolidated Amended Complaint at Counts V-IX were dismissed by the Plaintiffs via their Notice of Voluntary Dismissal. Further, all claims advanced by the Plaintiff in civil action 1:21-cv-00113 have now been dismissed. Therefore, there appearing to be no further matters pending before this Court as to any matter involved in this proceeding, the Clerk is directed to close it upon the docket of this Court, and to notify the Judicial Panel on Multidistrict Litigation of such actions. During the Video Status Conference on August 15, 2023, there was an Oral Motion, concurred by all counsel, to continue the stay of this case for the reasons outlined in the Joint Status Report (ECF No. 302 ), namely pending a decision by the Pennsylvania Supreme Court in companion cases in which Allocotur Petitions have been granted as to coverage issues germane to these proceedings. The Court GRANTS this Motion and CONTINUES THE STAY without prejudice to any party and pending further Order of the Court.
