MINUTE ORDER: Fed. R. Civ. P. 15(a)(1)(B) allows a party to amend a pleading as a matter of course within "21 days after service of a motion under Rule 12(b), (e), or (f)." This is an "absolute right" under the Rule. Villery v. District of Columbia , 277 F.R.D. 218, 219 (D.D.C. 2011). On August 30, 2021, Plaintiffs filed their20 First Amended Complaint as a matter of right within 21 days of Defendants'18 Motion to Dismiss. When "a plaintiff files an amended complaint as of right...the amended complaint becomes the operative pleading, and any pending motion to dismiss becomes moot." Barnes v. District of Columbia , 42 F. Supp. 3d 111, 117 (D.D.C. 2014) (citations omitted). Accordingly, because Plaintiffs'20 First Amended Complaint is now operative, it is hereby ORDERED that Defendants'18 Motion to Dismiss is DENIED AS MOOT. Defendants shall answer or otherwise respond to Plaintiffs'20 First Amended Complaint by February 28, 2022. It is further ORDERED that Plaintiffs shall file a redline comparison document displaying changes between the First Amended Complaint and the original, pursuant to the6 Standing Order, by February 4, 2022.
