Order on Motion to Remand to State Court
Fri 08/20 10:03 AM
ENDORSED ORDER: Plaintiff's "Notice of Case Removal" (Doc. 7 ), which the Court construes as a motion to remand to state court, is denied. Plaintiff's motion offers no basis to remand this action. In addition, to the extent Plaintiff attempts to assert a procedural defect in the removal, her motion is untimely since it was not filed within thirty days from removal. See 28 U.S.C. § 1447(c). Because Plaintiff alleges a violation of a federal statute, the Court has jurisdiction over the action. See 28 U.S.C. §§ 1331, 1441(a). Signed by Judge Thomas P. Barber on 8/20/2021. (EKB) |
