However, Plaintiffs have already withdrawn their previously filed motion to dismiss. See Text Order, January 3, 2022. The parties previously filed a Notice of Settlement and Withdrawal of Motion to Dismiss10 which is identical to the Notice14 currently before the Court. In response to said motion, the Court directed the parties to submit either a status report or a stipulation for dismissal of this action no later than February 1, 2022. See Text Order, January 3, 2022. Defendant has filed a status report requesting that this matter be set for a further status report to be filed on or about March 1, 2022, unless a stipulation for dismissal acceptable to this Court is filed prior to March 1, 2022. Accordingly, the parties are DIRECTED to file a further status report no later than March 1, 2022, unless a stipulation for dismissal acceptable to this Court is filed prior to March 1, 2022. Plaintiff has also filed a Motion to Strike15 , in which Plaintiff moves the Court to strike three documents that were filed erroneously. Plaintiffs Motion to Strike15 is GRANTED. Counsel and pro se Defendants Bryan Stover, Kyle Stover, and Joel Stover are directed to call the courtroom audio number of 571/353-2300, Call ID 338032881# to join the call. Attorneys and pro se parties are directed to comply with Federal Rule of Civil Procedure 26(f) by meeting as soon as practicable, and in any event at least fourteen (14) days prior to the scheduling conference, and are to submit a proposed discovery plan in writing to the Court on or before 8/6/2021. Such a plan must include, at a minimum, those items listed in CDIL-LR 26.2(3), Rule 16(b), Rule 26(f), and CDIL-LR 16.2(E) with proposed deadlines.
