Minute Entry for Status Conference proceedings held on 11/7/2024 before Magistrate Judge James R. Cho. Appearances by Tyrone Anthony Blackburn for plaintiff; Steven David Isser for defendant Petty. This is the second conference in a row where plaintiff's counsel has appeared late. Status of discovery discussed. As set forth in plaintiff's letter 109 , defendant failed to appear for his scheduled deposition. Defendant's deposition has been re-scheduled for 12/19/2024. The Court extends the fact discovery deadline to 12/19/2024 for the sole purpose of completing defendant's deposition and discovery that arises from the deposition. For the reasons stated on the record, the Court denies plaintiff's motion 109 for costs associated with the cancellation of defendant's deposition. Plaintiff waived any request for fees associated with the cancellation. On 11/1/2024, plaintiff served additional discovery requests. In light of the extension of time granted to complete defendant's deposition, parties shall meet and confer regarding plaintiffs additional discovery requests. Defendant reserves the right to object based on the timeliness of the discovery requests. If parties are unable to resolve issues relating to the additional discovery requests, parties shall file a joint discovery letter by 11/21/2024 . In-person status conference scheduled for 1/8/2025 at 11:00 a.m. in Courtroom 11-D South before Magistrate Judge James R. Cho. The parties shall meet and confer regarding an expert discovery schedule in advance of the conference. The Court anticipates entering an expert discovery schedule at the 1/8/2025 conference.
