Baxter: Defense counsel responds to plaintiff's counsel's discovery concerns noted in their letter (Docket No.16 ) and requests a three week extension to provide discovery responses due to health issues that caused him to miss three weeks of work. Plaintiff's counsel responds, stating that they are amenable to a two week extension and requests the responses be produced without any objections. For reasons stated on the record, the court grants defense counsel a three week extension to provide discovery responses (to 2/7/2023), and declines to impose any sanctions on the defense. Plaintiff's counsel advises that he has served expert disclosures and viewed discovery as complete other than the delinquency of the defense responses to his written demands. Defense counsel informs the Court that he there is no need for a responsive expert report and clarifies that he is not looking to re-open discovery, except to complete defense responses to plaintiff's demands. Defense counsel notes that the City of Utica is working towards a more global settlement regarding the accessibility of all of its municipal parks to individuals with disabilities, which may take some additional time. Deadlines are stayed and the parties are directed to file a status report by February 21, 2023 indicating how they want to proceed with the case and proposing any remaining deadlines.
