ORDER REGARDING 32 Motion to Certify Class and 33 Motion for Summary Judgment. As stated in the attached Order, Plaintiff's purported withdrawal of Multi-State Class Claims is GRANTED. The multi-state fraud claims are DISMISSED WITHOUT PREJUDICE. Plaintiff's purported withdrawal of Consumer Fraud Claims under the Illinois Consumer Fraud Act is GRANTED. The associated fraud claims are DISMISSED WITH PREJUDICE. Defendant's Motion for Summary Judgment is GRANTED. Plaintiff's claims under the Illinois Consumer Fraud Act concerning the alleged misrepresentations of the use of the word "lite" are DISMISSED WITH PREJUDICE. Plaintiff's unjust enrichment claim under Illinois law is DISMISSED WITH PREJUDICE. Accordingly, Plaintiff's Motion for Class Certification is DENIED AS MOOT.
