ORDER. For the reasons explained in the attached, the Court enters the following orders:    (1)    Plaintiff’s 18 Second Motion to Amend the Complaint is GRANTED. Counsel for Plaintiff shall serve the second amended complaint upon the existing and added parties and file it on the docket forthwith.    (2)    Plaintiff’s 21 Second Motion to Modify the Scheduling Order is GRANTED. The case deadlines are MODIFIED as follows:        a.    Any required response to the second amended complaint must be made within fourteen (14) days after service of the amended pleading, pursuant to Federal Rule of Civil Procedure 15.         b.    The newly added defendants will have until August 21, 2023 to respond to the 7 Application for Prejudgment Remedy. A hearing on the Application will be scheduled shortly thereafter.        c.    All discovery, including depositions of expert witnesses pursuant to Fed. R. Civ. P. 26(b)(4), shall be completed by October 2, 2023.         d.    All dispositive motions shall be filed on or before December 4, 2023.        e.    The joint trial memorandum required by the Standing Order on Trial Memoranda in Civil Cases shall be filed on or before January 8, 2024, or thirty (30) days after a ruling by the Court on the last filed dispositive mo-tion, whichever is later.         f.    The case will be ready for trial by February 12, 2024, or thirty (30) days after the filing of the joint trial memorandum, whichever is later.    It is so ordered. ELECTRONIC SCHEDULING ORDER. The Court has reviewed the Parties’9 Joint Rule 26(f) Report and Proposed Scheduling Order , which is hereby APPROVED AS MODIFIED. As an initial matter, the Court notes that Defendant appeared on May 27, 2022, see Doc. 8; therefore, the Parties’ deadline to file a Rule 26(f) Report was July 11, 2022. (Local Rule 26(f) provides that, within thirty days after the appearance of any defendant, the attorneys of record and any unrepresented parties must confer for purposes described in Fed. R. Civ. P. 26(f). D. Conn. L. Civ. R. 26(f). Local Rule 26(f) further provides that, no later than two weeks after the conference, the participants must jointly file a report of the conference using Form 26(f). Id. ) In this case, the parties did not confer as required until July 8, 2022, and did not file a report of the conference until August 16, 2022—more than a month late. See Doc. 9 at 1. Accordingly, it is hereby ordered that the Parties jointly file on or before November 4, 2022 a written statement signed by all counsel of record explaining why sanctions should not be imposed for their failure to comply with Local Rule 26(f). Secondly, certain of the deadlines proposed by the parties are substantially longer than those typically issued by this Court. The Court therefore sets forth the following modified case deadlines. Plaintiff may move to join additional parties or to amend the pleadings until December 30, 2022 . Defendant may move to join additional parties until February 17, 2023 and shall respond to the amended complaint within the time ordinarily provided by the applicable rules. Motions filed after the foregoing dates shall require, in addition to any other requirements under the applicable rules, a showing of good cause for the delay. All discovery, including depositions of expert witnesses pursuant to Fed. R. Civ. P. 26(b)(4), may commence upon entry of this Scheduling Order and shall be completed by April 21, 2023 . Depositions of fact witnesses shall be completed by December 30, 2022 . A damages analysis shall be provided by any party who has a claim or counterclaim for damages by January 27, 2023 . The Parties shall designate all trial experts and provide opposing counsel with reports from retained experts pursuant to Fed. R. Civ. P. 26(a)(2) on any issues on which they bear the burden of proof by January 27, 2023 . Depositions of any such experts shall be completed by February 24, 2023 . The case will be ready for trial by June 26, 2023 , or thirty (30) days after the filing of the joint trial memorandum, whichever is later. Should a dispute arise regarding the contours of discovery, as Doc. 9 at 6 suggests may occur, the parties shall first comply with the requirement in the Federal Rules to confer in good faith to attempt to resolve the dispute, see Fed. R. Civ. P. 37, and only then, if so advised, shall they promptly file motions and accompanying memoranda of law seeking the Court’s intervention. The occurrence of a discovery dispute shall not automatically stay the foregoing deadlines. Finally, the Court has reviewed Plaintiff’s7 Motion for Prejudgment Remedy . Defendant has not objected to this motion. Pursuant to the Local Rules and Connecticut law, Defendant may “request a hearing to contest the application for a prejudgment remedy, assert any exemption or make a request concerning the posting or substitution of a bond.” Conn. Gen. Stat. § 52-278d(g); see also D. Conn. L. Civ. R. 4(c). Defendant is therefore ORDERED, on or before November 18, 2022 , to file a notice and, if so advised, a memorandum of law, indicating its position on the7 Motion for Prejudgment Remedy , at which point the Court will schedule a hearing, if requested.
