21 | 21 PAPERLESS ORDER denying (ECF No. 20) Join Motion to Continue Preliminary Hearing/Arraignment Date. Defendant had his first appearance nearly a year ago, on November 13, 2020. Since that time, he and the government have repeatedly and successfully persuaded the Court to postpone his arraignment. In the Motion now before the Court, the parties state that they "are in plea negotiations and hope to resolve this matter before the government proceeds to the Grand Jury" and they ask for a 90-day postponement of that deadline. (ECF No. 20). This follows a series of motions that have secured multiple lengthy postponements of Defendant's arraignment. On February 16, 2021, the parties filed a motion to continue the arraignment, to allow for plea negotiations, and asked for a 60-day continuance, which the Court granted. (ECF Nos. 13, 14). On April 14, 2021, the parties asked for a 90-day postponement of arraignment, which the Court granted. (ECF Nos. 15, 16). Again, on July 13, 2021, the parties filed a motion for another 90-day postponement of arraignment, again to foster plea negations, which the Court again granted. (ECF Nos. 17, 18). Presumably, each time the parties made these motions they had a good faith basis to believe that in the time period they requested, they would finalize their negotiations, either with or without an agreement. Title 18 U.S.C. section 3161(h)(7)(A) provides that the court may grant a continuance of arraignment only if the court "sets forth, either orally or in writing, its reasons for finding that the ends of justice served by the granting of such continuance outweigh the best interests of the public and the defendant in a speedy trial." This record provides the Court with no explanation why the parties have made these serial motions for lengthy continuances and now are asking the Court for yet another, very long, postponement of the deadline for the government to present its case to a grand jury. In particular, on this record, the Court has no basis upon which to believe that 90 more days are needed for these negotiations and that the parties will accomplish this goal in the 90-day period they request. This record does not inform the Court why further postponing the arraignment outweighs the interests of the public and the Defendant in a speedy trial. Therefore, the Court hereby ORDERS that the Joint Motion to Continue Preliminary Hearing/Arraignment Date, (ECF No. 20), is DENIED . Signed by Magistrate Judge Chris M. McAliley on 10/14/2021.
