Order on Motion to Dismiss
Thu 07/27 12:24 PM
ORDER re Motion to Dismiss as Stipulated (Doc.39 ). The Court construes the pending Motion to Dismiss as a Stipulation of Dismissal. Under Federal Rule of Civil Procedure 41(a)(1)(A)(ii), a Stipulation of Dismissal signed by all the parties who have appeared in the action is effective immediately upon filing and does not require judicial approval. See e.g., Jenkins v. Village of Maywood , 506 F.3d 622, 624 (7th Cir. 2007). Accordingly, all claims in this action are DISMISSED with prejudice. The Clerk of the Court is DIRECTED to enter judgment and close the case. Signed by Chief Judge Nancy J. Rosenstengel on 7/27/2023. (kss) |

Order 60 Day
Tue 06/27 8:52 AM
60-DAY ORDER: The undersigned Chief District Judge has been advised that this action is settled in its entirety, but the parties need additional time to finalize the settlement. Accordingly, the undersigned Chief District Judge DIRECTS the Clerk of Court, 60 days after this Order is docketed, to ENTER JUDGMENT OF DISMISSAL with prejudice. Each party shall bear its own costs, unless otherwise provided in the settlement documents. The parties shall also obey the terms and conditions of the settlement documents, particularly the provision requiring prompt payment of any settlement amount, if said provision exists. If the parties fail to finalize the settlement within the 60-day period, they may -- before that period expires -- move to postpone entry of judgment to a later date. Due to the settlement, the Court CANCELS all settings in this case. Responses due by August 28, 2023. Signed by Chief Judge Nancy J. Rosenstengel on 6/27/2023. (kss) |
