DOCKET TEXT ORDER (no separate order issued:) This proceeding is scheduled to come before the court on December 1, 2022 for a scheduling conference. On October 14, 2022, the court entered an order (Dkt. 9) approving a Stipulation (Dkt. 7) between Plaintiff Michael I. Goldberg and Defendants Richard Mahrer, Nancy Mahrer, E*Trade Advisor Services FBO Richard Mahrer, MTC, LLC CFBO Richard Mahrer Trad #A****, and Richard Mahrer (in his capacity as Trustee of the Richard and Nancy Mahrer Family Trust) that extended Defendants' deadline to respond to Plaintiff's complaint to October 28, 2022. Nothing has been filed. Accordingly, the court ORDERS as follows: (1) Within 10 court days following issuance of this Docket Text Order, Mr. Goldberg shall file a request for entry of Defendants' default, pursuant to Fed. R. Bankr. P. 7055 and Fed. R. Civ. P. 55(a). (2) Within 30 days after the Clerk of Court has entered Defendants' default, Mr. Goldberg shall file a motion for default judgment pursuant to Fed. R. The Oct. 14 Order also vacated the court's September 16, 2022 Docket Text Order and with it, the initial scheduling conference set for March 2, 2023. The court must conduct a scheduling conference. Accordingly, the court orders as follows: (1) The court will convene a scheduling conference on December 1, 2022 at 2:00 p.m. (2) The December 1 scheduling conference will convene via Zoom.
