DOCKET TEXT ORDER (no separate order issued:) Plaintiff Michael I. Goldberg commenced this adversary proceeding on July 26, 2022. On August 3, 2022, Mr. Goldberg filed a certificate of service (Dkt. 7) indicating that Puru and Sandhya Pandey were served with process by first class mail, in compliance with Fed. R. Bankr. P. 7004(b)(1). However, there is no proof of service with respect to Defendant Neha Pandey. Pursuant to Fed. R. Bankr. P. 7012(a), Puru and Sandhya Pandey's answer or other initial responsive pleading was due no later than August 26, 2022. Nothing has been filed. Accordingly, the court ORDERS as follows: (1) Within 10 days following issuance of this Docket Text Order, Mr. Goldberg shall file a request for entry of Puru and Sandhya Pandey's default, pursuant to Fed. R. Bankr. P. 7055 and Fed. R. Civ. P. 55(a). (2) Within 30 days after the Clerk of Court has entered Puru and Sandhya Pandey's default, Mr. Goldberg shall file a motion for default judgment pursuant to Fed. R. Bankr. P. 7055 and Fed. R. Civ. P. 55(b)(2). (3) No later than December 2, 2022, Plaintiff's counsel shall obtain an Alias Summons and serve Neha Pandey with process in a manner than complies with Fed. R. Bankr. P. 7004. (4) The scheduling conference is hereby continued to February 2, 2023 at 2:00 p.m. The continued scheduling conference will convene via Zoom. The court encourages all interested parties to consult the court's website for information about court operations during the COVID-19 pandemic. The court's website also offers information explaining how to arrange an appearance at a video hearing.
