MINUTE ORDER: GRANTING22 Motion to Amend Complaint. Because the court dismissed this case without prejudice, and "a dismissal of a complaint without prejudice is not a final appealable order," "the complaint may be amended pursuant to Rule 15(a) of the Federal Rules of Civil Procedure without filing a motion pursuant to Rules 59(e) or 60(b)." Wilcox v. Georgetown Univ., 987 F.3d 143, 146 (D.C. Cir. 2021). Moreover, the court concludes that it is in the interest of justice to allow Plaintiff to amend her his Complaint. See Fed. R. Civ. P. 15(a)(2) (court "should freely give leave" for a party to amend a pleading "when justice so requires"). Amendment would not be futile because, in the proposed Second Amended Complaint, Plaintiff reframes his defamation by implication claim, alleging that Defendants defamed him by implying that he engaged in odious behavior, such as harassing or bullying--not that Defendants defamed Plaintiff by implying specifically that he engaged in sexual harassment.
