FILED OPINION (CARLOS T. BEA, MILAN D. SMITH, JR. and LAWRENCE VANDYKE) For the foregoing reasons, we REVERSE the district courtâ??s order which held that Plaintiffsâ?? Fourth Amendment rights were not violated. In light of the governmentâ??s expressed willingness in its â??Motion to Vacate and Remand with Instructions to Grant Plaintiffsâ?? Requested Relief,â?? to have the district court order the â??FBI to sequester or destroy the records of its inventory search pertaining to class membersâ?? (ECF No. [12836419-2]), we REMAND for the district court to order the FBI to so dispose of the records, including copies of the records kept on the Sentinel database. See CDT, 621 F.3d at 1162.
