For the reasons set forth in the attached ruling, the Motion of Defendants Zaiger LLC and Jeffrey Zaiger to Dismiss the Second Amended Complaint (ECF No. 59) and Defendants Black Diamond Capital Management, LLC and Stephen Deckoff's Motion to Dismiss Second Amended Complaint (ECF No. 61) are hereby GRANTED. The Sixth Count and the Tenth Count are dismissed with prejudice; the Twelfth Count is dismissed with prejudice; and the court declines to exercise supplemental jurisdiction over First, Second, Third, Fourth, Fifth, Seventh, Eighth, Ninth, Eleventh, and Thirteenth Counts.
