ORDER denying15 Motion for Pre Motion Conference. By letter dated September 20, 2023, defense counsel seeks what amounts to a protective order against the plaintiff in this case, Mr. Deabold ("Plaintiff"), on the basis that Deabold has repeatedly communicated directly with him (and others) via email over eight (8) times in the span of several hours that same day regarding statements made by defense counsel at the TRO hearing held in this matter on April 26, 2023, before Judge Azrack. See generally ECF15 and attachments. Deabold writes that he intends to report defense counsel to the bar grievance committee unless defense counsel "correct[s] the record." See id. ; See ECF [13-1] ("You have until the end of the day to correct the record or face possible discipline."); ECF [13-9] at 2 ("should you refuse I will file the written complaint"). Further, a review of the TRO transcript shows that Deabold's allegations do not match what was stated at TRO hearing. Compare ECF [15-1] at 1 with TRO Hearing Transcript (ECF11 ) at 8:7-11). Additionally, Deabold has contacted former employers of defense counsel, who have asked not to be further included. See ECF [13-10]. Defense counsel has only responded once to Deabold and only to remind Deabold that any communications to him should be made through Deabolds counsel. See ECF 13-2. It should be made clear that Deabold has been at all times represented by counsel, Attorney Silberling, and Attorney Silberling is included on the email communications with the Deabold and defense counsel. See, e.g. , ECF [13-1], [13-2]. Defense counsel requests a protective order barring the Deabold from contacting him directly about this case. See ECF 15 at 2. However, defense counsel provides no basis of authority upon which the Court may act upon such request. Thus, the motion is DENIED on these grounds.Nonetheless, a "federal court... may exercise its inherent power to sanction a party or an attorney who has 'acted in bad faith, vexatiously, wantonly, or for oppressive reasons.'" Abreu v. Receivable Collection Servs. , LLC, No. 18-CV-04103(PKC)(LB), 2019 WL 1876722, at *2 (E.D.N.Y. Apr. 26, 2019) (quoting Ransmeier v. Mariani , 718 F.3d 64, 68 (2d Cir. 2013)). "Courts of justice are universally acknowledged to be vested, by their very creation, with power to impose silence, respect, and decorum, in their presence, and submission to their lawful mandates." Chambers v. NASCO, Inc. , 501 U.S. 32, 43 (1991) (citation omitted). "These powers are governed not by rule or statute but by the control necessarily vested in courts to manage their own affairs so as to achieve the orderly and expeditious disposition of cases." Id. (citation and quotation marks omitted). See Mickle v. Morin , 297 F.3d 114, 125 (2d Cir. 2002) ("A court has the inherent power to supervise and control its own proceedings and to sanction counsel or a litigant for bad-faith conduct."). While the Court does not make any factual findings at this time or impose sanctions, Deabold's conduct is nonetheless troubling. The Court is equally concerned if Attorney Silberling has not intervened with respect to his client's conduct. All counsel and parties are advised and are hereby on notice that any further reports of such conduct will result in an in-person hearing to show cause before the Court and that the Court may impose the necessary sanctions to deter such conduct, up to and including dismissal of the action. First, to the extent the plaintiff's affidavit attached to the response letter seeks reconsideration of Judge Azrack's order denying the TRO, see ECF 10-1 at 3, that request is DENIED as it fails to provide any controlling decisions or data the Court has overlooked. Shrader v. CSX Transp., Inc., 70 F.3d 255, 257 (2d Cir.1995) ("The standard for granting such a motion is strict, and reconsideration will generally be denied unless the moving party can point to controlling decisions or data that the court overlooked matters, in other words, that might reasonably be expected to alter the conclusion reached by the court."). Second, the Court GRANTS the defendants' request for a pre-motion conference and will hold a hearing on September 6, 2023 , at 11:00am to address the contentions raised in the letters as well as any outstanding requests for injunctive relief.
