Order on Motion for Extension of Time to File Response/Reply/Answer

PAPERLESS ORDER. THIS CAUSE came before the Court upon Defendant Farmington State Bank d/b/a Moonstone Bank's ("Moonstone") Unopposed Motion to Extend its Deadline to Reply to Plaintiffs' Opposition to its Motion to Dismiss the Amended Administrative Class Action Complaint. ("Mot.")858 . On January 15, 2025, Moonstone filed its Motion to Dismiss the Amended Complaint (ECF No. 822), and on February 28, 2025, Plaintiffs filed their Response in Opposition (ECF No. 848). The deadline for Moonstone to file a Reply in support of the Motion to Dismiss is March 31, 2025. (ECF No. 831). However, on March 19, 2025, Moonstone filed a Motion to Strike Plaintiffs' Response in Opposition to the Motion to Dismiss (ECF No. 857), arguing that Plaintiffs improperly included nine exhibits that are outside Plaintiffs' pleading and included unsupported and misleading statements outside of the pleadings. (ECF No. 857). In the instant Motion, Moonstone requests that the Court extend its deadline to file its Reply in support of its Motion to Dismiss "until twenty (20) days after the Court rules on its Motion to Strike, or alternatively, until twenty (20) days after Plaintiffs file a revised Opposition to Moonstone's Motion to Dismiss." Mot. at 2. Moonstone states that if the Motion to Strike is granted "it will change (potentially significantly change) the Opposition to which Moonstone would be replying" and "it would be substantively unfair to Moonstone to require it to reply to Plaintiffs' Opposition as currently constructed." Id. at 2-3. Plaintiffs do not oppose the requested relief. Id. at 3. Accordingly, UPON CONSIDERATION of the Motion, the pertinent portions of the record, and being otherwise fully advised in the premises, it is hereby ORDERED AND ADJUDGED that the Motion858 is GRANTED.
