OPINION AND ORDER. The Court strikes its previous order (ECF No. 12) taking Defendant's motion to dismiss (ECF No. 7) under advisement. Defendant may file a reply brief on or before 3/14/2024. The Court GRANTS Plaintiff's motion (ECF No. 13) for a sixty-day extension of time in which to seek legal representation. Plaintiff shall have until 4/29/2024 to seek legal representation and the Court will abstain from resolving Defendant's motion to dismiss until after 4/29/2024. The Court DENIES Plaintiff's motion to admit evidence (ECF No. 16). The Court DENIES Plaintiff's request for an interpreter at this time (ECF No. 15). Therefore, Defendant's Motion to Dismiss (ECF 40) is GRANTED in part and DENIED in part: Defendant's Motion to Dismiss under Federal Rule of Civil Procedure ("Rule") 12(b)(6) is GRANTED and Defendant's Motion to Dismiss under Rule 41(b) is DENIED. Defendant's request for a vexatious litigant order is DENIED. Additionally, Plaintiff has leave to amend and is ordered to file an amended complaint within two (2) weeks of this Order being filed if Plaintiff is able to cure the pleadings deficiencies discussed in the F&R.
