TEXT ORDER denying Plaintiff Jane Does Letter Motion27 requesting reconsideration: The motion has not shown any of the three grounds upon which a district court may justifiably reconsider its previous ruling: (1) an intervening change in controlling law, (2) new material evidence not able to have previously been discovered, or (3) a demonstrated need to correct clear error of law or to prevent manifest injustice. Delaney v. Selsky, 899 F. Supp. 923, 925 (N.D.N.Y. 1995). Plaintiff Jane Does motion appears to be based on the third grounda need to correct clear error of law or prevent manifest injustice. However, the law is clear in this Circuit that [a] non-attorney parent may not bring an action on behalf of his or her child without representation by counsel. Lipsman ex rel. Lipsman v. New York City Bd. Of Educ., 13 F. Appx 13, 13 (2d Cir. 2000) (citing Cheung v. Youth Orchestra Found. of Buffalo, Inc., 906 F.2d 59, 61 (2d Cir. 1990)). Moreover, the Court does not perceive a manifest injustice in the application of this rule based on the record before it. As a result, Plaintiffs Letter Motion27 is DENIED. NYC Dept of Educ., 23-CV-10396, 2024 WL 167287, at *3 n.3 (S.D.N.Y. Jan. 16, 2024) (citing Cheung v. Youth Orchestra Found. of Buffalo, Inc., 906 F.2d 59, 61 (2d Cir. 1990); Tindall v. Poultney High Sch. Dist., 414 F.3d 281, 284 (2d Cir. 2005) (holding that it is a well-established general rule in this Circuit that a parent not admitted to the bar cannot bring an action pro se in federal court on behalf of his or her child)). Indeed, minors are entitled to trained legal assistance so their rights may be fully protected and nonlawyer parents are not trained to represent competently the interests of their children.
