Motion Hearing Order on Motion to Withdraw as Attorney Order on Motion for Extension of Time to Amend

Minute Entry for Motion Hearing proceedings held on 3/6/2025 before Magistrate Judge James R. Cho. Alan Gura and Nathan John Ristuccia appeared on behalf of plaintiffs. Jordan Doll and John J. Doody appeared on behalf of defendants David C. Banks, Community Education Council ("CEC") 14, New York City Department of Education ("DOE"), Nina S. Mickens, and Tajh Sutton ("Sutton") and Marissa Manzanares ("Manzanares") in their official capacities (collectively, "City defendants"). Movant Jonathan Wallace, defendants Manzanares (via telephone) and Sutton also participated. In connection with the motion to withdraw as counsel, the Court held ex parte discussions with defendants and their attorneys and the record from those portions of the conference shall remain under seal. The Court grants Mr. Wallace's 43 Motion to Withdraw and grants Sutton and Manzanares time to retain new counsel. The Court encourages Sutton and Manzanares to request representation from the City. For the reasons discussed at the conference, by 3/7/2025 , Mr. Wallace shall file a letter under seal with contact information for defendants Manzanares and Sutton. If Manzanares and Sutton elect to receive electronic notifications, their consent forms may be filed under seal (ex parte). The Court grants, in part, the parties' motions [71, 81] for an extension of the discovery schedule with modifications as follows: the DOE shall produce documents by 4/15/2025 ; no amendment of the pleadings or joinder of additional parties permitted after 5/1/2025 without good cause; and parties to complete fact discovery by 6/9/2025 . To the extent necessary, the City defendants shall move for a protective order by 3/17/2025 . Telephonic status conference scheduled for 4/8/2025 at 9:30 a.m. before Magistrate Judge James R. Cho. Each party is directed to call 571-353-2301 and enter Meeting ID 709-478-501#. Adjournment requests will not be considered unless made in accordance with this Court's Individual Rules. If any party has difficulty accessing the conference, please contact Chambers at 718-613-2110. If defendants Sutton and Manzanares fail to retain new counsel, they shall personally participate in the 4/8/2025 conference. Sutton and Manzanares may contact the City Bar Justice Center Federal Pro Se Legal Assistance Project at 212-382-4729 for limited legal assistance. They may also contact the Pro Se Office at the United States Courthouse by calling 718-613-2665. The Court holds plaintiffs' motion to compel 70 in abeyance to give Sutton and Manzanares an opportunity to retain new counsel.
