ORDER: In light of the Court's order granting in part and denying in part Plaintiff's motion for conditional certification, ECF No.48 , the Court DENIES WITHOUT PREJUDICE Defendant's motion to compel arbitration, ECF No.38 . Defendant may refile its motion during stage two (the decertification stage). See Wilson v. Yellow Transp., Inc., No. 06-2281 CM, 2007 WL 445197, at *1 (D. Kan. Jan. 29, 2007) ("Rather than granting plaintiff's motion to stay briefing, however, the court will deny without prejudice the motions to compel arbitration.").
