Order Dismissing Case
Mon 09/16 10:19 AM
ORDER DISMISSING CASE: This action is dismissed for failure to serve defendant under Federal Rule of Civil Procedure 4(m). Rule 4(m) requires plaintiff to serve defendant with process within 90 days of the filing of the1 complaint, unless the time for service is extended. On 8/29/2024, the Court ordered that by 9/12/2024, plaintiff shall either file a letter stating when service was accomplished on defendant or, if service was not accomplished, show cause why the case should not be dismissed under Rule 4(m). The deadline has passed, and plaintiff still has not filed proof of service or otherwise responded to the Court's Order. This case is dismissed under Rule 4(m). See Thompson v. Maldonaldo , 309 F.3d 107, 109 (2d Cir. 2002) (approving sua sponte dismissal of a complaint under Rule 4(m) if the plaintiff had been given prior notice and an opportunity to show cause); see, e.g. , Brookliv LLC v. Meehan , No. 21-CV-7178 (RPK) (RER), 2022 WL 1488664, at *1 (E.D.N.Y. May 11, 2022) (dismissing complaint under Rule 4(m) "[b]ecause plaintiff has not properly served defendant and an extension of time to effect service is not warranted"). The Clerk of Court is respectfully directed to enter judgment and close this case. Ordered by Judge Rachel P. Kovner on 9/16/2024. (NNW) |
