Order on Motion for Conference
Thu 06/06 5:14 PM
ORDER denying without prejudice 30 Motion for Joint Parties' Planning Meeting Conference. The Court finds the plaintiff's request for the Court to schedule a conference to be premature. Attorney Miller has entered an appearance on behalf of the United States Post Office, Mark Darby, Tracy Malone, Teresa Santiago, and Tyneese Selby in their official capacities. (ECF No.27 .) The parties are directed to meet and confer regarding intended next steps, including the filing of a Rule 26(f) report, by July 11, 2024 . Signed by Judge Vernon D. Oliver on 6/6/2024. (Dao, J) |

Thu 06/06 5:12 PM
ORDER denying without prejudice 26 Motion for Separate Trials. The parties have not yet filed their joint Rule 26(f) report and thus, there is not yet a scheduling order with case deadlines. Accordingly, Plaintiff's request for separate trials is denied as premature. Plaintiff may renew the request for separate trials after a scheduling order is entered. Signed by Judge Vernon D. Oliver on 6/6/2024. (Dao, J) |

Order on Motion for Default Entry 55(a)
Thu 06/06 3:57 PM
ORDER denying 25 Motion for Default Entry 55(a). Plaintiff's request for default entry is denied as counsel has filed a notice of appearance for the United States Post Office, Mark Darby, Tracy Malone, Teresa Santiago, and Tyneese Selby in their official capacities. Moreover, as these individual defendants appear to be employees of the United States, the deadline for those individuals to respond to the complaint has not yet passed because they have sixty days to respond after service. Additionally, a review of the docket shows that Plaintiff has not yet served these individual defendants in their official capacities under Rule 4(i) of the Federal Rules of Civil Procedure. The Clerk is directed to reissue the summons and Plaintiff shall file proof of service. The Court directs Plaintiff to review the District of Connecticut's Guide for Self-Represented Litigants, which provides important information regarding motions to participate in electronic filing, service, and other topics relevant to self-represented parties. The Guide is available at the following link: [LINK:https://www.ctd.uscourts.gov/forms/guide-self-represented-litigants] Signed by Judge Vernon D. Oliver on 6/6/2024. (Dao, J) |

Order on Motion for Reconsideration
Thu 05/30 3:39 PM
ORDER denying 23 Motion for Reconsideration. "The standard for granting [a motion for reconsideration] is strict, and reconsideration will generally be denied unless the moving party can point to controlling decisions or data that the court overlooked - matters, in other words, that might reasonably be expected to alter the conclusion reached by the court." Shrader v. CSX Transp., Inc. , 70 F.3d 255, 257 (2d Cir. 1995). The Court finds that Plaintiff Wozar did not meet this standard and thus, his motion is denied . In response to Plaintiff Wozar filing a Complaint consisting of over one hundred pages, Attorney Tallberg publicly filed a request for an extension of time, representing that he was "still in the process of identifying and attempting to collect necessary information and documents" to "investigate the allegations in plaintiff's complaint." (ECF No. 21 .) Accordingly, there was good cause to grant the extension. Moreover, because the request was publicly filed on the docket, the Court finds that Plaintiff has not shown that Attorney Tallberg engaged in ex parte communication. The Court acknowledges Plaintiff's desire for the "matter to be concluded as soon as possible." (ECF No. 23 at 4.) In light of defense counsel filing a notice of appearance, the Court encourages the parties to meet and confer to explore the potential for settlement. It is so ordered. Signed by Judge Vernon D. Oliver on 5/30/2024. (Dao, J) |
