2 - Minute Order ~Util - Set/Reset Motion Noting Date ~Util - Set/Reset Deadlines
Wed 01/08 9:41 AM
MINUTE ORDER (text only) authorized by Judge Lauren King. Local Civil Rule 7(j) instructs litigants to seek relief from a deadline "sufficiently in advance of the deadline to allow the court to rule on the motion prior to the deadline." And parties "should not assume that the motion will be granted" (even if it is unopposed or stipulated) and "must [therefore] comply with the existing deadline unless the court orders otherwise." LCR 7(j). Plaintiff Annie Song filed her26 Unopposed Request for Extension Regarding Show Cause Order on the day her response to the Court's25 Order to Show Cause was due. That does not give the Court enough time to rule on the motion before the existing deadline expires. The Court nonetheless finds good cause to GRANT Song's request on this occasion. Song must file her response to the Court's25 Order to Show Cause by January 21, 2025. Failure to do so will result in dismissal of this case. Dkt. No.25 at 7; Fed. R. Civ. P. 12(h)(3). The Court also cautions Song that any further violations of the Local Civil Rules or other applicable law may result in sanctions. (NAW) |
