OPINION, MEMORANDUM AND ORDER: IT IS HEREBY ORDERED that Plaintiff's motion for leave to proceed in forma pauperis [ECF No. 2] is GRANTED and the filing fee is waived. See 28 U.S.C. � 1915(a)(1). IT IS FURTHER ORDERED that the Clerk shall not issue process or cause process to issue upon the complaint as to any defendant because the complaint fails to state a claim upon which relief can be granted. Plaintiff's claims against defendants City of Troy Police, Ron Sconce, Harold Horner, Gary Leifert, David Norman, Steven Jones, Rachel Dunard, and Kay Diekemper are DISMISSED without prejudice. See 28 U.S.C. � 1915(e)(2)(B). IT IS FURTHER ORDERED that Plaintiff's motion for appointment of counsel [ECF No. 3] is DENIED as moot. IT IS HEREBY CERTIFIED that an appeal from this dismissal would not be taken in good faith. An Order of Dismissal will accompany this Opinion, Memorandum and Order.
