Hearing held 7/2/2024 to consider (1) the Debtor's Cash Management Motion (14 ); (2) the Debtor's Post-Petition Credit/Cash Collateral Motion (16 ,15 ); and (3) the Debtor's Motion to Expedite Hearing on the Utility Motion (17 ,13 ). Justin Mertz and Davis Sullivan appeared for the Debtor, with Dale Boehm, the Debtor's principal owner and CEO, and Joel Waltersdorf, the Debtor's acting CFO; Jerome Kerkman appeared as the Subchapter V Trustee; and Dillon Ambrose appeared for the U.S. Trustee. The Court heard testimony from Mr. Boehm and admitted the Debtor's Budget for Cash Collateral Stipulation (23 ) into evidence. The Court granted the Cash Management Motion, and Mr. Mertz will file a revised proposed order. Subject to the revisions to the cash collateral budget outlined on the record, the Court also granted the request in the Post-Petition Credit/Cash Collateral Motion to use cash collateral and obtain credit on an interim basis through conclusion of a final hearing scheduled for 7/22/2024 at 9:30 a.m. at the United States Courthouse at 517 East Wisconsin Avenue, Room 167, Milwaukee, Wisconsin. If no objections are filed on or before 7/19/2024 at 3:00 p.m. Central Time, the Court will cancel the hearing by docket entry and enter a final order. Mr. Mertz will file a revised proposed order granting the Post-Petition Credit/Cash Collateral Motion's interim requests, providing notice of the final hearing, and providing notice of the objection deadline. Upon receipt of the signed order, Mr. Mertz will serve the order and file a certificate of service on or before 7/5/2024. Finally, Mr. Mertz will file a revised proposed order requiring objections to the Utility Motion to be filed on or before 7/17/2024 and stating that a hearing will be held on 7/22/2024 at 9:30 a.m. at the United States Courthouse at 517 East Wisconsin Avenue, Room 167, Milwaukee, Wisconsin only if an objection is timely filed. Upon receipt of the signed order, Mr. Mertz will serve the order and file a certificate of service on or before 7/5/2024. An audio recording of the hearing is available on the docket.
