ORDER re2 MOTION for Leave to Proceed in forma pauperis: Mr. Derosiers has 30 days in which to file an Amended Complaint showing that the defendant acted "under color of state law" when he committed the alleged assault or, instead, whether he was acting as a private citizen. If Mr. Derosiers files an Amended Complaint, the Court will then review it per 28 U.S.C. § 1915(e)(2)(B)(ii) to decide whether there are sufficient factual circumstances pled to support a claim for relief. If there are, the Court will then rule on the pending I.F.P. Application. If Mr. Derosiers does not file Amended Complaint, or if an Amended Complaint does not cure the pleading defect, the Court will dismiss the case. So Ordered by Chief Judge John J.
