ORDER denying37 Motion to Withdraw Notice of Voluntary Dismissal. As noted by Plaintiff in his Notice of Voluntary Dismissal of Case [ECF 35] pursuant to F.R.C.P. 41(a)(1(A)(i), he was entitled to dismiss the action without Court Order by filing his Notice of Dismissal before the opposing party served an Answer or a Motion for Summary Judgment. Here, the operative pleading is the Amended Complaint [ECF31] filed November 29, 2024. The Notice of Voluntary Dismissal [ECF 35] was filed December 23, 2024, before Defendant filed an Answer to the Amended Complaint. While Plaintiff filed this Motion to Withdraw Notice of Voluntary Dismissal [ECF37] on December 26, 2024, Plaintiffs Motion to Withdraw Notice of Voluntary Dismissal [ECF 37] was ineffective because this Court was deprived of jurisdiction based upon Plaintiff's filing of his Notice of Voluntary Dismissal [ECF 35]. The effect of the filing of the Notice of Dismissal was to leave the parties as though no action had been brought. Duke Energy Trading & Mktg., L.L. C. v. Davis, 267 F.3d 1042, 1049 (9th Cir. 2001). Accordingly, Plaintiffs claims were automatically dismissed as of the date of filing of the Notice of Voluntary Dismissal [ECF 35] on December 23, 2024.
