TEXT ORDER dismissing Plaintiffs'12 Amended Complaint for failing to state a claim and denying their2 -6 ,13 Motions for Leave to Proceed in forma pauperis as moot. While Plaintiffs have demonstrated an inability to pay the filing fee, the Amended Complaint does not include a short and plain statement of the claim showing that Plaintiffs are entitled to relief. See Fed. R. Civ. P. 8(a)(2). Specifically, the Amended Complaint fails to connect any individual defendants to the harm alleged by the Plaintiffs. See generally Am. Compl. In a text order entered on September 13, 2024, the Court found that Plaintiffs' original Complaint, ECF No. 1, did not meet the requirements of Fed. R. Civ. P. 8(a)(2). Rather than dismiss the Complaint under 28 U.S.C. § 1915(e)(2)(B)(ii), the Court afforded Plaintiffs thirty (30) days to file an amended complaint, which they have done. But Plaintiffs' Amended Complaint also fails to meet the requirements of Fed. R. Civ. P. 8(a)(2), as detailed above. Accordingly, the 12 Complaint is DISMISSED and the 2 - 6 , 13 Motions for Leave to Proceed in forma pauperis are DENIED as moot. So Ordered by District Judge William E. Smith on 10/18/2024. TEXT ORDER reserving on2 -6 Plaintiffs' Applications to Proceed in forma pauperis . Plaintiffs'1 Complaint does not include a "short and plain statement of the claim showing that the pleader is entitled to relief." Fed. R. Civ. P. 8(a)(2). Instead, the Complaint is a lengthy and convoluted statement consisting of conclusory assertions about the constitutionality of certain statutes and legal principles devoid of context. See generally Compl. Crucially, Plaintiffs' Complaint fails to connect any individual defendants to the harm alleged by Plaintiffs. Id. While the Court is mindful that Plaintiffs are pro se litigants and views pro se complaints liberally, it cannot credit the conclusory statements that make up the entirety of Plaintiffs' Complaint. See Rodrguez-Reyes v. Molina-Rodrguez , 711 F.3d 49, 53 (1st Cir. 2013) (noting where "the factual allegations in the complaint are too meager, vague, or conclusory," dismissal is warranted); Dandy v. United States , No. CA 10-288-ML, 2010 WL 3292609, at *1 (D.R.I. July 26, 2010) , report and recommendation adopted , No. CA 10-288-ML, 2010 WL 3292181 (D.R.I. Aug. 17, 2010). Rather than dismiss the Complaint for failing to state a claim, the Court affords Plaintiffs thirty (30) days to file an amended complaint under Federal Rule of Civil Procedure 15. Failure to file an amended complaint by that deadline will result in dismissal under 28 U.S.C. § 1915(e)(2)(B)(ii). So Ordered by District Judge William E. Smith on 9/13/2024.
