ORDER: For the reasons stated on the record at the January 7, 2025 Initial Pretrial Conference, it is hereby ORDERED that Defendant shall oppose Plaintiffs' motion for a preliminary injunction (Dkt. No. 32) no later than January 31, 2025, and Plaintiffs shall file their reply in support of their motion for a preliminary injunction no later than February 7, 2025. Counsel shall inform the Court of their positions on whether an evidentiary hearing is necessary for the Court to adjudicate Plaintiffs' preliminary injunction motion and, if so, the number of witnesses each party intends to call and the approximate length of their anticipated testimony, in a joint letter not to exceed three pages, filed on ECF as soon as practicable, but no later than February 11, 2025. If either party believes that an evidentiary hearing is warranted, such party shall also inform the Court of their witnesses' availability to appear at an evidentiary hearing on Thursday, February 20, 2025, or Monday, February 24, 2025. It is further ORDERED that counsel for all parties shall appear for an evidentiary hearing and/or oral argument on Plaintiffs' motion for a preliminary injunction on Thursday, February 20, 2025 at 10:30 a.m. in Courtroom 906 of the Thurgood Marshall Courthouse, 40 Foley Square, New York, NY 10007. The Court has also requested that all counsel hold Monday, February 24, 2025 as a backup date for the hearing in the event that necessary witnesses are unavailable to appear on February 20. It is further ORDERED that Defendant's request that discovery be stayed pending resolution of the motion to dismiss (Dkt. No. 20) is GRANTED IN PART, such that discovery will be stayed pending resolution of Plaintiffs' motion for preliminary injunction. SO ORDERED. Responses due by 1/31/2025 Replies due by 2/11/2025. Although "[t]he common law right of public access to judicial documents is firmly rooted in out nation's history," that right is not absolute, and courts "must balance competing considerations against" the presumption of access. Lugosch v. Pyramid Co. of Onondaga, 435 F.3d 110, 119-20 (2d Cir. 2006) (internal references omitted); see also Nixon v. Warner Commc'ns, Inc., 435 U.S. 589, 599 (1978) ("[T]he decision as to access is one best left to the sound discretion of the trial court, a discretion to be exercised in light of the relevant facts and circumstances of the particular case.").
