MINUTE ORDER denying7 8 Motions for Reconsideration: The Court construes Plaintiff's filings at ECF7 and8 as motions to reconsider this Court's dismissal of her complaint or for recusal. These motions provide no legitimate basis for the Court to reconsider its prior order dismissing the case. For example, Plaintiff argues that her complaint is subject to Federal Rule of Civil Procedure 9(b), not Rule 8, because she asserts RICO claims. But even assuming that Rule 9(b) applies, "Rule 9 merely excuses a party from pleading discriminatory intent under an elevated pleading standard. It does not give him license to evade the less rigid... strictures of Rule 8." Ashcroft v. Iqbal , 556 U.S. 662, 686-97 (2009); see Taitz v. Obama , 707 F. Supp. 2d 1. 6 (D.D.C. 2010) ("[Plaintiff's] fraud claims fail to even meet the standards of Rule 8, much less the heightened requirements of Rule 9(b)."). Nor do these motions provide any basis for recusal. A litigant's dissatisfaction with a judge's ruling is not evidence of bias and does not present grounds for recusal. See Liteky v. United States , 510 U.S. 540, 555 (1994) ("[J]udicial rulings alone almost never constitute a valid basis for a bias or partiality motion."). It is therefore ORDERED that Plaintiff's7 8 motions for reconsideration and recusal are DENIED, and her request to transfer this matter to the U.S. District Court for the Northern District of New York is therefore DENIED as moot.
