ORDER: Defendant Neutron Holdings, Inc. removed this purported class action from Queens County Supreme Court on October 24, 2024, invoking this Court's diversity jurisdiction under 28 U.S.C. § 1332(d). ECF No.1 . The record does not reflect whether plaintiff has served the other defendants in this action. Plaintiff shall serve the other defendants by January 22, 2025 and file proof of service on the docket. See Kogan v. Facebook, Inc. , 334 F.R.D. 393, 399 n.3 (S.D.N.Y. 2020) ("Rule 4(m)'s 90 -day period for service begins to run on the date of removal." (citation omitted)). Separately, defendant Neutron Holdings, Inc. requests, with plaintiff's consent, an extension of time to respond to plaintiff's complaint. ECF No. 4 . Although it was not made in compliance with my Individual Rules, the request is granted as first requests for an extension are generally granted as a courtesy. Defendant Neutron Holdings, Inc. shall respond to the complaint by November 21, 2024.
